Explain whether, and why, given practices, policies, and conduct breach CFA Institute's Code of Ethics and its Standards of Professional Conduct
The idea
Explaining why conduct complies is as testable as spotting a breach. Anchor the explanation in the element that is or is not met: was the information both material and nonpublic; was the disclosure made before the agreement and in plain language; was the consent written; did the supervisor restrict the employee rather than just warn them. Separate requirements from best practice, because avoiding a conflict instead of disclosing it, voting every proxy, reporting to a regulator and, where no rule sets a period, keeping records for seven years are recommendations rather than obligations. Distractors often reach the right verdict for the wrong reason, or cite a Standard that does not govern the act, so read the reason as carefully as the verdict.
